Summary
An OUSD(A&S) memorandum from the Principal Director, Defense Pricing and Contracting, on reporting requirements for DFARS Clause 252.223-7999, "Ensuring Adequate COVID-19 Safety Protocols for Federal Contractors" (Deviation 2021-O0009). It directs DoD Components to submit weekly refusal reports when contractors decline to accept the clause (or its Other Transaction Agreement equivalent) in awards, orders, OTAs, or bilateral modifications valued at $10 million or more, or above the simplified acquisition threshold with significant mission impact, beginning December 9, 2021. Relevant to OTs in that it extends the safety-protocol clause and refusal reporting to Other Transaction Agreements.
