Statutory text of Section 815 of the FY2016 NDAA (Pub. L. 114-92), which added Section 2371b to Title 10 (later recodified as 10 U.S.C. 4022) establishing DoD authority to carry out prototype projects through other transactions. It sets the dollar thresholds that trigger written determinations by senior procurement executives or the Under Secretary for Acquisition, Technology, and Logistics (over $50M-$250M, and over $250M), a preference for competitive procedures, Comptroller General audit-access clauses, and the appropriate-use conditions (nontraditional defense contractor participation, all-small-business/nontraditional participants, one-third cost share, or a written exceptional-circumstances finding). This is the foundational statute for DoD prototype other transactions.
