Summary
A provision of the FY23 National Defense Authorization Act (Pub. L. 117-263), Section 843, clarifying and reforming DoD other transaction authority by amending 10 U.S.C. 4022. It broadens the statutory definition of "prototype project" to include proof of concept, reverse engineering to address obsolescence, pilot or novel application of commercial technologies, agile development, and demonstration of operational utility, and it establishes a pilot authority for using OTs on installation or facility prototyping (capped at two projects per fiscal year and $200 million aggregate, with a September 30, 2025 sunset). Central to the scope of what qualifies as an OT prototype effort.
