Summary

A DoD Defense Pricing and Contracting memorandum updating implementation of Executive Order 14042 (COVID-19 safety protocols for federal contractors) in Other Transaction Agreements, revising and superseding a prior October 8, 2021 memorandum. Implementing preliminary injunctions issued by federal district courts (Southern District of Georgia, December 7, 2021, and Eastern District of Kentucky, November 30, 2021), it directs agreements officers not to enforce or include the attached COVID-19 safety-protocols clause in new solicitations or existing OT agreements, and attaches the affected clause text.
